What Can a Private Investigator Not Do?
1. Tap or Bug Phones and Property
Despite popular portrayals in movies and TV shows, private investigators are not permitted to tap phones or bug properties. These activities fall under wiretapping and eavesdropping laws, which are strictly regulated and typically only permissible for law enforcement agencies with proper warrants. Any private investigator caught engaging in these activities could face severe legal consequences.
2. Obtain Phone Records
Private investigators do not have the legal authority to obtain phone records without the consent of the individual. Phone records are protected under privacy laws, such as the Telephone Records and Privacy Protection Act, which makes it illegal for anyone to obtain them through deceptive means. Any investigator promising to acquire such records without appropriate authorization is likely operating outside the law.
3. Get Copies of Text Messages or Emails
Accessing someone's text messages or emails without their consent is a direct violation of privacy laws, including the Electronic Communications Privacy Act. Private investigators cannot hack into personal devices or email accounts to retrieve these communications. This type of activity is illegal and can lead to serious legal repercussions for both the investigator and the client.
4. Obtain Bank Records
Similar to phone and communication records, bank records are highly confidential and protected by various privacy laws, such as the Gramm-Leach-Bliley Act. Private investigators cannot legally access someone's bank records without their explicit permission. Any attempt to do so would be considered a breach of privacy and could result in criminal charges.
